1. Acceptance of Terms
By accessing or using the services provided by Kuecher Counseling LLC ("we," "our," or "us"), including but not limited to in-person therapy, telehealth counseling, our website, and any related communications, you ("you" or "client") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
Kuecher Counseling LLC provides professional therapy and counseling services, including but not limited to:
Individual therapy and counseling
Couples and relationship counseling
Family therapy
Group therapy
Telehealth and virtual counseling sessions
Crisis intervention and referral services
Our services are provided by licensed mental health professionals in accordance with applicable state and federal laws.
3. Eligibility
Our services are available to individuals aged 18 and older. Minors may receive services with the written consent of a parent or legal guardian, except where state law permits minors to consent to their own mental health treatment. By using our services, you represent that you have the legal capacity to enter into a binding agreement.
4. Informed Consent
Before beginning treatment, you will be asked to sign an Informed Consent form that outlines the nature of therapy, potential risks and benefits, confidentiality, and your rights as a client. Therapy is a collaborative process, and your participation is voluntary. You have the right to ask questions about your treatment at any time and to discontinue services at your discretion.
5. Telehealth Services
Kuecher Counseling LLC offers telehealth services through HIPAA-compliant video and communication platforms. By participating in telehealth sessions, you acknowledge and agree to the following:
Telehealth is not appropriate for all clinical situations, and your therapist may recommend in-person sessions when clinically indicated
You are responsible for ensuring a private, secure environment during telehealth sessions
Technical difficulties may occur; we are not liable for disruptions caused by internet connectivity or equipment failures
Telehealth services are subject to the same confidentiality protections as in-person sessions
You may withdraw consent for telehealth services at any time and request in-person services instead
Telehealth services may be limited by state licensing laws; services are only available in states where our therapists are licensed to practice
6. Confidentiality
We take your confidentiality seriously. All information shared during therapy is kept strictly confidential in accordance with HIPAA, applicable state laws, and professional ethical standards. There are limited exceptions where disclosure may be required by law, including but not limited to:
When there is a risk of imminent harm to yourself or others
When there is suspected abuse or neglect of a child, elder, or dependent adult
When disclosure is required by a court order or other legal process
When required for mandatory public health reporting

7. Appointments and Cancellations
Consistent attendance is important for the effectiveness of therapy. Please adhere to the following policies:
Scheduling: Appointments may be scheduled by phone, email, or through our online scheduling system.
Cancellations: If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Failure to provide adequate notice may result in a cancellation fee.
Late Cancellation Fee: Appointments cancelled with less than 24 hours' notice may be subject to a fee equal to the full session rate.
No-Shows: If you fail to appear for a scheduled appointment without notice, you may be charged the full session rate.
Late Arrivals: If you arrive late to a session, the session will still end at the originally scheduled time. The full session fee will apply.
8. Fees and Payment
Fees for services will be discussed and agreed upon prior to the start of treatment. Payment policies include:
Payment is due at the time of service unless other arrangements have been made in advance
We accept cash, check, credit card, and HSA/FSA (please confirm accepted methods with our office)
If you are using insurance, you are responsible for verifying your coverage and understanding your benefits, including copays, deductibles, and any limitations
You are responsible for any charges not covered by your insurance plan
Unpaid balances may be subject to collection efforts after reasonable attempts to resolve the matter directly
9. Insurance
If you choose to use insurance for payment, please be aware that your insurance company may require disclosure of certain clinical information, including diagnosis and treatment details, as a condition of coverage. By authorizing us to bill your insurance, you consent to the release of necessary information to your insurance provider.
10. Emergencies
Kuecher Counseling LLC does not provide emergency or crisis services. If you are experiencing a mental health emergency, please take one of the following actions immediately:
Call 911 or go to your nearest emergency room
Call the 988 Suicide and Crisis Lifeline by dialing 988
Contact the Crisis Text Line by texting HOME to 741741
Therapy sessions are not a substitute for emergency psychiatric care.
11. Communication Policy
We may communicate with you via phone, email, text message, or through a secure patient portal. Please be aware that standard email and text messaging are not secure methods of communication. By providing your email address and phone number, you consent to receive communications from us through these channels for scheduling, reminders, and general correspondence. Do not use email or text to communicate urgent or emergency matters.
12. Intellectual Property
All content on our website, including but not limited to text, images, graphics, logos, and downloadable materials, is the property of Kuecher Counseling LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written consent.
13. Limitation of Liability
Kuecher Counseling LLC and its therapists provide services in good faith and in accordance with professional standards of care. However, therapy outcomes cannot be guaranteed. To the fullest extent permitted by law:
We are not liable for any indirect, incidental, special, or consequential damages arising from the use of our services
We are not liable for any harm resulting from your reliance on information provided during therapy or on our website
Our total liability for any claim arising from our services shall not exceed the fees paid by you for the specific services giving rise to the claim
14. Indemnification
You agree to indemnify and hold harmless Kuecher Counseling LLC, its therapists, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of our services, your violation of these Terms of Service, or your violation of any rights of a third party.
15. Termination of Services
Either you or Kuecher Counseling LLC may terminate the therapeutic relationship at any time. We reserve the right to terminate services if:
Continued treatment is not clinically appropriate or beneficial
You fail to comply with treatment recommendations or office policies
There are unpaid balances that remain unresolved after reasonable attempts at collection
There is a conflict of interest or ethical concern that cannot be resolved
If services are terminated, we will provide appropriate referrals to other providers when possible.
16. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the state in which Kuecher Counseling LLC is licensed to operate, without regard to conflict of law principles. Any disputes arising from these terms or our services shall be resolved in the appropriate courts of that jurisdiction.
17. Dispute Resolution
In the event of a dispute arising from these Terms of Service or our services, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation, the parties may agree to mediation before pursuing any formal legal action.
18. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
19. Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of our services after any modifications constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
